Chapter 1: Terms and Conditions of Services

1. Acceptance of Terms

By using Lety Agent and Lety Marketing, you agree to be bound by these terms and conditions. If you do not agree, you must not access or use the services.

2. Storage and Security

Data is stored securely on AWS (Amazon Web Services) and payments are processed through Stripe, ensuring the protection of your financial information.

2.1. The processing of personal data captured by LETY, i.e., the data of its users, is regulated by the policy found at https://www.lety.ai/privacy-policy

2.2. Personal data captured by Lety users while using Lety services shall be the sole responsibility of the user, and such processing shall be subject to each user's own data processing policy.

3. Installations and Integrations

Once the user decides to acquire Lety services, they may opt to take the additional installation service or specific integrations required to connect LETY to their tools or processes. These additional services will be quoted by the Lety team and communicated to the user.

If the user contracts installation services, the value of which will be communicated in the demo meeting, they will have support from the Lety team according to the scope communicated in the demo meeting. If the user decides to perform the installation on their own, they access the installation instructions and proceed to register for the plan and install the services.

4. Plans, Subscription Model, and Payments

4.1 Plans: Lety offers its users different plans according to the needs of each business. These plans are published on our website www.lety.ai and are duly explained to users in initial meetings, as well as in chats with the Lety virtual agent. The plans offered may vary from time to time, and such changes will take effect immediately, without prior notice. Unless otherwise indicated, any change in price or scope will take effect from the beginning of the next monthly subscription period. If the user does not agree with a change in the subscription service, they may cancel their subscription as indicated in the terms and conditions.

4.2 Payments: Lety services operate under a monthly subscription on two platforms: Lety Agent and Lety Marketing, with payments automatically debited from your account through Stripe on each of these platforms. Payments work as follows:

4.2.1 First Payment: The first payment is made on the day of registration or on the day of completion of the trial period, if the user has been a candidate for this commercial incentive.

4.2.2 Monthly Payments: The cut-off date for monthly payments will always be the same, 30 calendar days after the first payment.

4.2.3 Late Payment: To avoid cancellation of the service, the customer must pay on their cut-off date and may pay up to 7 days after the cut-off date (4 charge attempts will be made to their card), but the cut-off date will remain the same. In case of late payment, the next charge will be made 30 days after the cut-off date, minus the days of delay.

5. Additional Subscriptions and/or Payments

According to the user's needs, they may require additional subscriptions such as WhatsApp Business, WhatsApp API, ChatGPT:

5.1 WhatsApp Business, WhatsApp API: When the user requires these tools as a communication channel, LETY will be installed on them, which will generate a monthly charge for the user, subject to the current rates of these platforms. The user must subscribe through a link or QR that will be sent during the registration process, and payments will be debited by the platform to which they subscribe.

5.2 ChatGPT: At the time of subscription to the LETY plan and depending on the plan, the user will be charged certain monthly credits, included in the plan, to be consumed in any type of ChatGPT model. Once these are consumed, the user must recharge credits to continue generating messages in the LETY chat, according to the ChatGPT model used. The recharge of these credits will be automatically scheduled and charged by automatic debit each time credits are recharged.

5.3 Additional Lety Marketing Features: Lety Marketing plans have a defined scope communicated to the user before subscription; however, the platform offers multiple additional features that the user can acquire for an additional value.

6. Commercial Incentives

In order to incentivize its users, Lety may design and execute specific campaigns or offer incentives to new or existing users. Such incentives or campaigns will be communicated to users with the respective detail and scope.

In the case of offering free trial periods for new users, these trials will be executed under the following rules:

The free trial period is activated only through specific links, as follows:

6.1 Start: The customer registers on the platform through the link sent by the sales team and begins their free trial period.

6.2 System Exploration: During the free trial days, the customer can test Lety Agent and Marketing, and the customer can connect all communication channels.

6.3 Completion: On the day of completion of the free service, if the customer decides not to continue with the service, they must state this on that day through hello@lety.ai

6.4 Service Continuity: If the customer indicates they wish to continue with the service or if they do not respond on the day of completion of the free trial, continuity of the service is assumed, and therefore the first charge will be generated according to the selected plan.

6.5 Non-Continuity: If the customer does not wish to continue with the service, they must send a message to hello@lety.ai within the free trial days. This way, the cancellation will be processed and no charge will be made by Lety. In the event that a charge has been generated during this period, a 100% refund will be made. If the user acquired any additional service or subscription during this period, that money will not be refunded.

7. Cancellation

At Lety, no permanence is required. If the customer wishes to cancel, they can send a message requesting cancellation to hello@lety.ai, or they can do so directly on the platform by following these steps:

  • Go to the Account section.
  • Go to Subscription and unlink.
  • Remove the payment method from that section.

Once the cancellation is made, the service will terminate on the next billing cut-off date, and no additional charges will be made. The days of service already paid between the cancellation filing date and the cut-off date will not be refunded by Lety.

In case of cancellation by the customer's decision or due to non-payment, all customer content on both platforms will be deleted. If the user wishes to resume services, they must complete the entire information upload process again.

8. Refunds

Refund requests will be analyzed by the Lety team and will apply in the following events: (i) billing errors, (ii) charges made during the days of any free trial offered as a commercial incentive, provided that the refund request has been filed within a period of up to seven (7) calendar days after the date of the respective charge. (iii) Cancellation requests for semi-annual or annual plans: In this case, the customer may request a refund of the amounts corresponding to the service plan after the cancellation filing date. Installation values included in these plans will not be refunded.

No refunds will be made for services prior to cancellation requests, nor for the days of service elapsed between a cancellation request and the user's effective cut-off date.

In case of cancellation, credit recharge refunds will work according to the following rules:

(i) Credits charged by Lety to the customer's account for payment of their monthly plan will not be refundable regardless of whether they have been consumed or not.

(ii) Credits recharged directly by the Customer and consumed will not be refundable.

(iii) Credits purchased directly by the Customer that have not been charged to their account at the time of cancellation will be refunded.

(iv) Credits recharged directly by the Customer and not consumed as of the effective date of cancellation will be refundable.

9. User Responsibilities

The user is responsible for the instructions provided to the AI agent. At Lety, we are not responsible for responses generated from inappropriate or incorrect instructions.

10. Intellectual Property Rights / Content Ownership

All content, software, and design of the services are the property of LetyAI Inc or are duly licensed from or to a third party.

11. Limitation of Liability / Disclaimer

We shall not be liable for indirect, incidental, special, or consequential damages. Maximum liability shall not exceed the amount paid by the user in the last 12 months.

12. Right of Suspension or Termination

LetyAI Inc reserves the right to suspend or discontinue the service or any part thereof at any time and without prior notice and shall not be liable to the user for such determination.

13. Applicable Law / Dispute Resolution / Applicable Laws

The services provided herein shall be governed by the laws of Texas, USA. For dispute resolution, arbitration or mediation shall be used before going to court.

14. Modifications to Terms / Changes / Updates

We reserve the right to modify these terms at any time, with immediate effect upon publication on the platform.

Chapter 2: Security, Integrity, and Confidentiality

LETY.AI works with two platforms that store and manage user information: (I) Lety Agent and (ii) Lety Marketing. Below, we present in this document the policies of each regarding information:

1. Lety Agent

Security Details of the Lety Agent Platform

At Lety Agent, we prioritize the security and confidentiality of your data. We implement the following measures to ensure a robust and secure platform:

  • Secure Hosting: Our platform is securely hosted with a reliable provider with advanced infrastructure and strict security protocols.
  • Two-Factor Authentication (2FA): To improve login security, we use two-factor authentication, providing an additional layer of protection against unauthorized access.
  • Cloudflare Protection: We use Cloudflare services to protect the platform against DDoS attacks and ensure secure data transmissions.
  • 256-Bit Encrypted Database: The database is secured with 256-bit encryption, ensuring a high level of protection for stored data.
  • GDPR Compliant Data Management: Conversation data is handled in full compliance with the General Data Protection Regulation (GDPR), reaffirming our commitment to user privacy and rights.
  • Secure API Connections: Specific query data is sent to OpenAI through secure API connections, maintaining the highest security standards during data transmission.

Data Types

When using the chat interface, the following data is entered by end users:

  • Email: Only collected at login for authentication. If using Google Auth or external authentication, it is optional.
  • Chat Messages: Collected when the user sends messages to the AI agent.
  • Prompts, AI Configurations, and Integrations: Specific customization for each agent/client.
  • User Preferences: Includes colors, sizes, typography, links, and animations.
  • Training Data: Uploaded documents (DOC, TXT, PDF, etc.) and online data sources (e.g., Notion, Google Drive).

  • Performance and Miscellaneous: We may use third-party service providers to maintain and improve our Service.

AI Model Data Usage

All your conversations in the system are strictly confidential and are never used for model training purposes.

OpenAI guarantees that data sent through its API is not used to train its models.

  • OpenAI retains API inputs and outputs for a maximum of 30 days to identify abuse and provide the service. After this period, the data is deleted, unless retention is required by legal obligations.
  • Data may be reviewed by authorized employees for abuse monitoring and legal compliance but is not used for model training.

2. Lety Marketing

Security Controls of Lety Marketing

We use multiple layers of administrative, technical, and physical controls to protect the data entrusted to us.

Infrastructure Security

  • Cloud Hosting Providers: We do not host systems or product data in physical offices. Our infrastructure resides on Google Cloud Platform and Amazon Web Services (AWS) in the USA. Google guarantees uptime of at least 99.5%, while AWS offers between 99.95% and 100% reliability. AWS complies with SOC 2 Type 2 and ISO 27001.
  • Network and Perimeter Security: The infrastructure uses connection filtering and inspection, logical firewalls, and access control lists to prevent unauthorized access. Firewall rules are reviewed periodically.
  • Configuration Management: Automation allows scalability, and server configurations are strictly controlled. Servers that do not meet standards are restored within 30 minutes. Security updates are handled automatically.
  • Event Logging: All actions and events are logged and stored centrally. Access to these logs is restricted to a small group of authorized engineers.
  • Alerts and Monitoring: We use automated monitoring and response capabilities to detect and handle issues such as attacks or anomalies.

Application Security

  • Web Application Defenses: Customer content is protected by firewalls and tools that detect malicious behavior, following OWASP guidelines.
  • Development and Release Management: We implement a continuous approach to development, dynamic security testing, and automated deployments, with segmentation between QA and production environments.
  • Vulnerability Management: Scanners are used to detect vulnerabilities and annual penetration tests. Findings are prioritized for mitigation.
  • Tenant Separation: Lety Marketing offers a multi-tenant SaaS solution where customer data is logically separated through unique IDs. Authorization rules are built into the architecture and are continuously validated. Authentication activities and access changes are logged.
  • Encryption: Data in transit is encrypted with TLS 1.2 or 1.3 and 2048-bit keys or better. Data at rest is protected with AES-256 encryption, and passwords are stored using recommended hashing practices.
  • Key Management: Encryption keys in transit and at rest are securely managed by the platform. TLS is renewed annually. Currently, customer-provided keys cannot be used.
  • Backup and Disaster Recovery: Systems have redundancy distributed across availability zones. Backups are performed daily and retained for seven days. Access to backups is restricted and protected against modifications.
  • Identity and Access Control: Customers can create detailed authorization rules to manage users and privileges. Employee access is limited through a role-based model (RBAC), and direct connections to infrastructure require strict authentication.
  • Policy Management and Training: Employees receive background checks, cybersecurity and phishing training, and must adhere to documented security policies, reviewed annually.
  • Vendor Management: Security controls are implemented for vendors. Company-issued laptops are protected with full disk encryption and mobile device management solutions.
  • Compliance: Lety Marketing does not store credit card information and uses PCI-DSS compliant payment processors
